Brazil’s New Insurance Law: What Changes in Contracts?

Starting December 11, 2025, Law No. 15,040/2024, known as the New Legal Framework for Insurance, took effect, replacing provisions of the Civil Code and modernizing the rules for the insurance sector. But what does this actually mean in practice?

The new law brings more transparency, good faith, and balance to the relationship between insurers and policyholders. Here are the main points:

Deadline to accept proposals: The insurer now has 25 days to accept or reject a proposal. If it doesn’t respond within that window, the proposal is automatically considered accepted.

Payment of claims: Once coverage is confirmed, the insurer has 30 days to make the payment. Any denial must be formal and justified, stating the legal or contractual reason.

Clarity on exclusions: Contracts must clearly and unambiguously highlight what risks aren’t covered. In case of doubt, the interpretation will favor the policyholder.

Requesting documents: The insurer can only request documents once, and can’t ask for information it already has or that’s easily accessible.

Good faith and cooperation: Failing to uphold these principles can lead to consequences for either party, including liability for losses and damages.

This change aims to reduce litigation, increase predictability, and build greater trust in the insurance market. For anyone taking out a policy or working in the field, it’s essential to understand these new rules.
