NR-1 Updates: Mental Health at Work. Is Your Company Ready?
Regulatory Standard (NR) No. 01 from Brazil’s Ministry of Labor and Employment (MTE) sets out guidelines for occupational risk management, and it also serves as the basis for other NRs.
In August 2024, NR-01 was updated through Ordinance No. 1,419/2024, which now requires the identification and control of psychosocial risks in companies’ Risk Management Program (PGR).
In other words, NR-01 now establishes that Work-Related Psychosocial Risk Factors must be considered in occupational risk management, alongside physical, chemical, and biological agents, accidents, and ergonomic risks.
- When does Ordinance No. 1,419/2024, which brought the updates to NR-01, take effect?
It was originally scheduled to take effect on May 26, 2025, but the Government decided to spend one year applying it in an educational and guidance-focused way so that companies can adapt to the requirements.
As a result, the penalties set out in the Ordinance will only be applied starting May 26, 2026. We stress that the Government’s intention is for companies to already be adapted when the Ordinance takes effect.
- What risks should companies watch for and mitigate?
Chronic occupational stress;
Burnout syndrome;
Moral and sexual harassment;
Excessive mental load;
Imposing goals that are extremely hard to reach;
Demands for hyperconnectivity.
How can a company comply with the new NR-01 requirements?
NR-01 requires companies to identify risks and to draw up and implement effective action plans. Some examples of measures include:
- Work reorganization and effective working-hours control. Excessive overtime and hyperconnectivity should be avoided.
- Encouraging a healthy environment. Strengthening employees’ emotional well-being.
- Institutionalized policies to prevent harassment, discrimination, and other behaviors that harm employees’ mental health.
- Training and capacity building. Talks on harassment-related topics can be important, especially those aimed at managers, who must maintain a healthy work environment.
- Reporting channels. Depending on the company’s size and needs, ethics channels can be an important means of evidence for risk mitigation and for actively listening to employees, as long as they are implemented with confidentiality and used responsibly and efficiently.
- Review of the PGR with qualified professionals (an occupational physician and a safety engineer, plus a specialized attorney).
