What Determines the Outcome of an Employment Dispute?
Since 2022, Brazil’s Federal Supreme Court (STF) and Superior Labor Court (TST) have maintained a continuous process of updating labor law and reviewing established legal interpretations, with a direct impact on companies’ day-to-day operations. This movement focuses on five areas: hiring, outsourcing, collective bargaining, corporate structure, and employee termination.
In all these areas, the outcome of a potential employment dispute is often determined not by the legal arguments presented in court, but by documents prepared months or even years earlier, usually by the Human Resources (HR) department.
In this context, operational decisions made by HR in coordination with the legal department carry significant financial implications. HR professionals must stay informed and up to date to ensure that every operational decision takes current case law into account and serves the company’s best interests.
The goal is not to turn HR into a legal department, but to ensure that the team receives the appropriate support. The legal department plays a preventive role: translating court precedents into objective guidelines, reviewing contract templates, policies, and communications, and training the team to ensure that day-to-day decisions reduce, rather than increase, labor liabilities.
In this context, labor liabilities are risks that begin long before a lawsuit is filed. This highlights the importance of having a strong, well-informed HR department working closely with the legal team.
