Arbitration Law Turns 30: A Consolidated Instrument Still Underused in Northeast Brazil
On September 23, 2026, Law No. 9,307/1996 completed 30 years. Arbitration has evolved from a relatively little-known alternative into one of the most relevant mechanisms for resolving business disputes in Brazil.
The possibility of submitting complex disputes to decision-makers with specialized technical knowledge, greater procedural flexibility and speed have contributed to making arbitration an increasingly common choice in major business contracts across the country.
Despite this progress, the use of arbitration in Northeast Brazil remains lower than that observed in the country’s largest economic centers. This scenario highlights the need to broaden awareness of arbitration among companies, investors and lawyers, demonstrating its advantages and suitability for resolving complex disputes.
The expansion of arbitration depends on a cultural shift and on the availability of solid, independent arbitration chambers with national experience, capable of providing security, credibility and technical excellence throughout proceedings.
Thirty years after the enactment of Law No. 9,307/1996, arbitration has demonstrated its legitimacy and effectiveness. The current challenge is to expand its reach, particularly in regions where its potential remains far from being fully explored.
